1. Acceptance of Terms
By downloading, installing, accessing, or using Vision Guard (“the App”), you (“User”, “you”, or “your”) agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App.

2. License Grant & Restrictions
2.1 License Types

2.2 “Lifetime License” Definition - CRITICAL TERMS
⚠️ IMPORTANT: A “Lifetime License” means:

- • One-time payment with no recurring fees
- • Access to all Pro features available at time of purchase
- • All updates and bug fixes released at Developer's sole discretion
- • Use of the App for as long as it remains available and functional
❌ What “Lifetime” DOES NOT INCLUDE:
- • NOT a guarantee of perpetual support or updates
- • NOT a guarantee the App will function forever
- • NOT tied to your lifespan or any specific time period
- • NOT a commitment to maintain compatibility with future macOS versions
- • NOT a guarantee of customer support indefinitely
- • NOT an obligation for Developer to continue operating
“Lifetime” means: The lifetime of the App's availability, which may be terminated at any time per Section 11 (Discontinuation of Service).
2.3 License Grant
Subject to your compliance with these Terms, Developer grants you a limited, non-exclusive, non-transferable, revocable license to:
- Install and use the App on Mac devices you own or control
- Use the App for personal or commercial productivity purposes

3.1 Pricing & Payment
- All prices are in USD (or local currency via App Store)
- Prices may change at any time; changes do not affect existing licenses
- All purchases are processed through Apple App Store or RevenueCat
- Developer does not store or process payment information
3.2 Subscriptions (Pro Monthly/Yearly)
- Auto-Renewal: Subscriptions automatically renew unless canceled 24 hours before renewal
- Cancellation: Cancel anytime via App Store account settings
- No Refunds: No refunds for partial subscription periods (see §3.4)
- Price Changes: You'll be notified of subscription price increases
3.3 Lifetime License - ONE-TIME PAYMENT
Payment Terms:
- One-time, non-recurring payment
- Payment is final and non-refundable after 14 days (see §3.4)
- License does NOT grant ownership of the App, only right to use
- License is bound to your Apple ID and non-transferable
No Ongoing Obligation:
- Developer has no obligation to provide updates, support, or maintenance beyond 14-day refund window
- Developer may discontinue the App at any time (see §11)
- No refunds if App is discontinued after 14-day window
3.4 Refund Policy

4. System Requirements & Compatibility
4.1 Minimum Requirements
At Launch (January 2025):
- macOS 13.0 (Ventura) or later
- Apple Silicon (M1/M2/M3) or Intel processor
- 50 MB available storage
- Internet connection for license validation and payments only
4.2 Compatibility Disclaimers
⚠️ IMPORTANT:
- • Developer does NOT guarantee compatibility with future macOS versions
- • Developer may drop support for older macOS versions without notice
- • App may cease functioning after macOS updates beyond Developer's control
- • Developer has no obligation to update App for new macOS versions
- • No refunds for loss of compatibility (after 14-day refund window)

Vision Guard is NOT a medical device and is NOT intended to diagnose, treat, cure, or prevent any disease or medical condition.
⚠️ NOT MEDICAL ADVICE:
Eye exercises and break reminders are for informational and wellness purposes only, not medical advice.
⚠️ CONSULT A DOCTOR:
If you experience eye pain, vision changes, or any medical symptoms, stop using the App immediately and consult a qualified healthcare professional.
⚠️ NO GUARANTEED RESULTS:
Developer makes NO claims or guarantees about health benefits, eye strain reduction, or productivity improvements.
⚠️ USE AT YOUR OWN RISK:
You assume all risk associated with using the App for wellness purposes.
6. Discontinuation of Service - CRITICAL SECTION
6.1 Right to Discontinue
Developer reserves the absolute right to discontinue, suspend, or terminate the App at any time, for any reason, with or without notice, including but not limited to:
- Business decision to cease operations
- Deletion of Apple Developer account
- Financial unsustainability
- Personal reasons
- Regulatory or legal requirements
- Technical or security concerns
- Any other reason at Developer's sole discretion
6.2 No Refunds Upon Discontinuation
⚠️ CRITICAL - READ CAREFULLY:
IF THE APP IS DISCONTINUED:
By purchasing a Lifetime License or subscription, you explicitly acknowledge and accept the risk that the App may be discontinued at any time without refund.
7. Limitation of Liability
Maximum Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Developer's total aggregate liability to you for any and all claims arising from these Terms or use of the App shall NOT exceed the amount you paid for the App in the 12 months preceding the claim, or $50 USD, whichever is less.
For Free Tier users: Liability is limited to $0 (zero dollars).
Exclusion of Damages
DEVELOPER SHALL NOT BE LIABLE FOR:

Your use of the App is also governed by the Vision Guard Privacy Policy.

9. Dispute Resolution
9.1 Governing Law
These Terms are governed by the laws of Poland, without regard to conflict of law principles.
For EU Users: You also benefit from mandatory consumer protection laws of your country of residence.
9.2 Informal Resolution
Before filing any formal claim, you agree to:

- Allow 30 days for Developer to respond and attempt resolution
